Site: refers to the website accessible at www.peugeot.co.id

Elements: refers to all content of the Site which shall include all text, images, graphics, animation, videos, music, sounds, cookies, and other materials on the Site.

User: refers to any natural or legal person using the Site.

Access to the Site is possible without the User having to reveal his identity or any other personal information concerning him.

Please refer to the Privacy Policy on the Site as to how Peugeot processes the User’s data. 

The Site includes a cookie system. The User is therefore informed that during his access to the Site, cookies may be automatically installed on his browser. Cookies are files sent to User's hard drives to facilitate their navigation on the Site and to establish visitor statistics. These cookies do not contain any personal information.

The User can deactivate the sending of cookies by modifying the settings of their Internet browser.

The Elements of the Site are accessible via the Internet.

All costs relating to access to the Site and Elements, whether hardware, software, or internet access costs, are the responsibility of the User. The User is solely responsible for the proper functioning of his computer equipment as well as his access to the internet.

The User declares to accept the characteristics and limits of the Internet and acknowledges having knowledge of the nature of the Internet network and, in particular, its technical performance, response times for accessing, querying, or transferring information, risks of interruption, and more generally the risks inherent to any connection and transmission on the Internet.

Peugeot implements all reasonable means to ensure quality access to the Site and Elements, however, it is not bound by any obligation of the result to achieve this.

Subject to the User’s continued compliance with the terms and conditions set forth in the Legal Notice, Peugeot grants the User, a non-exclusive, non-transferable, limited right to access, use, display, and listen to the Site and the Elements thereon.

Peugeot authorizes the User to view and download the Elements at the Site only for your personal, non-commercial use. This authorization is not a transfer of title in the Materials and copies of the Materials and is subject to the following restrictions:

• the User must retain all copies of the Elements downloaded in compliance with all copyright and other proprietary notices contained in the Site;
• the User must not modify the Elements in any way or reproduce or publicly display, perform, distribute, or otherwise use them for any public or commercial / profit exploitation purpose; and
• the User must not transfer the Elements to any other person unless the User gives them notice of, and they agree to accept, the obligations arising under these terms and conditions of use.

The User agrees and undertakes to use this Site in accordance with national and international regulations, and in particular not to use it to display, download, send or transmit any content:

of a violent nature or likely to undermine the respect and dignity of the human person, equality between men and women, and the protection of children and adolescents, in particular through the manufacture, transport, and distribution of messages of a violent or pornographic nature or likely to harm human dignity;

• which encourages the commission of crimes and misdemeanors;
• which encourages the consumption of prohibited substances;
• which causes or may cause discrimination, hatred, and violence because of race, ethnicity, or nation;
• which is illegal, harmful, threatening, abusive, constitutive of harassment, defamatory, offensive, vulgar, obscene, threatening to the privacy of others, or likely to offend the sensibilities of certain people;
•  who misleads other Users by usurping the name or company name of other people;
• which infringes the rights of third parties such as without this list being exhaustive, any manufacturing secret, professional secret, confidential information, trademark, patent, and in general any industrial or intellectual property right or any other right relating to protected information or content; and/or
• including, but not limited to, computer viruses or any other code or programs designed to interrupt, destroy, or limit the functionality of any software, computer, or telecommunications tool.

The User undertakes to:

a)           regularly read the Legal Notices and respect them;

b)           not collect and store personal data relating to other Users;

c)           not harass in any way whatsoever one or more other Users; and/or

d)           not hinder or disrupt or attempt to hinder or disrupt the operation of the Site.

Peugeot grants no guarantee, express or implicit, that use of this Site will be uninterrupted, or free of errors, bugs or viruses and shall not be liable if, for any reason, this Site is unavailable at any time or for any computer virus or system free. Access to this Site may be suspended at any time without prior notice being given.

The User of the Site is informed that the Site and Elements:

•  are protected by copyright legislation: this may be particularly the case for photographs, articles, drawings, animated sequences, etc; and/or
•  are protected by legislation on designs and models: these are in particular the vehicle models appearing on the Site;
•  are protected by trademark legislation: these are in particular the “PEUGEOT” brand, the “complete stylized lion” brand (representing the AUTOMOBILES PEUGEOT logo), and the brands of vehicle models appearing on the site.

The Elements thus protected are the property of AUTOMOBILES PEUGEOT or third parties having authorized AUTOMOBILES PEUGEOT to exploit them.

Consequently, any reproduction, use, representation, adaptation, modification, incorporation, translation, marketing, partial or complete, by any process and on any medium whatsoever (paper, digital, etc.), of any of the Elements without the prior written authorization of Peugeot is prohibited (apart from the exceptions as herein contained) and shall be deemed an offense of counterfeiting of copyright and/or designs and models and/or trademark, punishable by the criminal and civil penalties provided for by the applicable legislation.

The User undertakes to indemnify Peugeot against any action which may be taken against it, or any complaint filed against it by a third party, due to any use of the Site by the User. The indemnity includes but is not limited to any sum that Peugeot is required to pay including attorney's fees and court costs recognized or awarded.

Peugeot grants no guarantee, express or implicit, as to the use of the Site by the User and in particular as to the availability, timeliness, reliability, and usefulness of the Site and the Elements. Peugeot also does not guarantee that the Site and Elements comply with the User's expectations at all material times. User agrees to use the Site and Elements at its own risk and shall not be held Peugeot responsible for his usage at all material times.

The User acknowledges and agrees that he accesses the Site and views the Elements therein at the User’s own discretion and risk and that Peugeot shall not be liable for any damages of any kind suffered or incurred by the User or any other person or entity, howsoever arising whether in contract, tort, negligence or otherwise, in connection with or as a result of the Site or access of the Site, including without limitation loss of data, economic loss, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive, general or special damages. This includes but is not restricted to loss or damage the User might suffer as a result of any of the following:

use and/or access (or inability or delay in the use and/or access) of the Site;

• any content or information made available on the Site (including any errors, omissions, or inaccuracies thereof);
• any interruption whether for the purpose of maintenance or intrusion or any attack by any person, hardware, software, virus, Trojan Horse, worm and/or macros or other harmful components arising from any use and/or access of the Site;
• any websites (including the content therein) maintained by third parties, which are accessible via a link from or to the Site; and/or
• any unauthorised access to or alterations of the User’s transmission or data.

The Site and the Elements are provided on an "as is" basis and is without warranty of any kind whatsoever, whether express or implied, including without limitation any implied warranties of its merchantability, accuracy, fitness for use, and/or non-infringement of third-party rights.

In addition, Peugeot is not responsible for the contents of websites that are maintained by third parties and therefore shall not be liable or responsible for any links from this Site to other websites accordingly.

The provision of details of products and services on this Site is not, and should not be construed as, an offer to sell or supply such products or services.

All illustrations, information, and specifications referred to on the Site are believed to be correct at the time of publication, however, it may contain errors inaccuracies or outdated information with the lapse of time. The models, equipment, and possible vehicle configurations illustrated on this Site may differ from the actual vehicles supplied in the market. All products and services on this Site are subject to availability and may be withdrawn without notice.

The Site and these Legal Notices are subject to Indonesia law.

Any dispute that arises concerning the interpretation and/or execution of these Legal Notices must be the subject of an attempt at amicable settlement.

In the absence of an amicable settlement, the dispute will be submitted to adjudication by local courts.
